Top Roundup Lawsuit Payouts Revealed

For years, Roundup was the most popular weed killer in the world, used on everything from residential lawns to massive commercial farms. Its manufacturer, Monsanto, aggressively marketed it as safe. Now, the company (acquired by Bayer) is facing one of the largest mass tort litigations in history, with juries awarding staggering sums to victims who developed cancer after using the product.

These massive payouts are more than just numbers; they represent accountability. They are a clear message from juries that Monsanto knew about the link between its flagship product and non-Hodgkin’s lymphoma and chose to hide the danger from the public. For victims in California and across the country, these landmark verdicts provide a path to justice.

At Walch Law, we believe in holding negligent corporations accountable. Call now to get started for free.

The Science: Why is Roundup So Dangerous?

The central issue in every Roundup lawsuit is its active ingredient, glyphosate. In 2015, the International Agency for Research on Cancer (IARC), a branch of the World Health Organization, classified glyphosate as “probably carcinogenic to humans.” This finding opened the floodgates for litigation.

The IARC’s conclusion was based on strong evidence that glyphosate causes DNA and chromosomal damage in human cells, leading to cancers like non-Hodgkin’s lymphoma. Victims in these lawsuits are typically individuals who had prolonged, direct exposure to Roundup over many years, including:

  • Groundskeepers and landscapers
  • Farmworkers and agricultural laborers
  • Nursery and garden center employees
  • Dedicated home gardeners

Despite Monsanto’s and Bayer’s continued insistence that Roundup is safe, juries have been consistently persuaded by the scientific evidence presented by plaintiffs’ attorneys, leading to eye-watering verdicts.

The Landmark Verdicts: Holding Monsanto Accountable

While thousands of cases have been settled out of court, a few groundbreaking jury verdicts have set the tone for the entire litigation. These high-profile cases established that Monsanto acted with malice and negligence, paving the way for substantial punitive damages.

1. Dewayne “Lee” Johnson: The First Domino to Fall

The first Roundup lawsuit to go to trial was a monumental event. Dewayne “Lee” Johnson, a former school groundskeeper from California, was diagnosed with terminal non-Hodgkin’s lymphoma after years of using Roundup and a similar product, Ranger Pro, as part of his job. He was often drenched in the chemical due to equipment malfunctions.

In August 2018, a San Francisco jury sided with Johnson, finding that Monsanto had failed to warn him of the cancer risk and had acted with “malice or oppression.” The jury awarded him an incredible $289 million. This award was broken down into:

  • $39 million in compensatory damages (for medical bills, lost wages, and suffering).
  • $250 million in punitive damages (to punish Monsanto for its conduct).

A judge later reduced the total award to $78.5 million, and it was further reduced on appeal to $20.5 million. Despite the reductions, the verdict was a landmark victory. It proved that a jury could be convinced of the link between Roundup and cancer and was willing to punish Monsanto for its behavior.

2. Edwin Hardeman: The First Federal Case

The second major trial involved Edwin Hardeman, a California man who had used Roundup on his 56-acre property for over two decades before being diagnosed with non-Hodgkin’s lymphoma. His was the first case to be tried in federal court as part of the Multidistrict Litigation (MDL).

In March 2019, a federal jury in San Francisco found that Roundup was a “substantial factor” in causing Hardeman’s cancer. The jury awarded him over $80 million. This included:

  • $5 million in compensatory damages.
  • $75 million in punitive damages.

The trial judge later reduced the punitive damages, bringing the total award down to approximately $25 million. This second consecutive victory for a plaintiff further solidified the legal argument against Bayer and put immense pressure on the company.

3. Alva and Alberta Pilliod: The Largest Verdict to Date

The most stunning verdict came in May 2019 in the case of Alva and Alberta Pilliod, a married couple from Livermore, California. Both were diagnosed with non-Hodgkin’s lymphoma after using Roundup on their properties for more than 30 years.

A jury in Oakland, California, delivered a jaw-dropping verdict of over $2 billion. The breakdown was astonishing:

  • $55 million in compensatory damages for the couple.
  • $2 billion in punitive damages ($1 billion for each spouse).

The jury found that Monsanto had failed to warn the couple about the cancer risks of its product. The sheer size of the punitive damage award reflected the jury’s outrage at the company’s conduct. A judge later reduced the total award to $86.7 million, but the initial verdict sent shockwaves through the corporate world. It was the largest product liability verdict of the year and remains a high-water mark in the Roundup litigation.

What Do These Payouts Mean for Future Victims?

These massive verdicts are about more than just money. They have fundamentally shaped the landscape of the Roundup lawsuits.

First, they established a clear legal precedent that the evidence linking glyphosate to cancer is strong enough to convince a jury. Second, the enormous punitive damage awards demonstrated that juries are willing to punish Bayer for Monsanto’s decades-long effort to hide the risks of its product.

This track record of success forced Bayer to the negotiating table. In 2020, the company announced it would pay over $10 billion to settle a majority of the existing Roundup claims. While this global settlement covered tens of thousands of cases, many victims did not participate, and new lawsuits continue to be filed.

Your individual case value will depend on many factors, including the severity of your illness, your age, the extent of your medical bills, and your level of exposure. However, the precedent set by Johnson, Hardeman, and the Pilliods provides a strong foundation for all future negotiations and trials.

Your Legal Rights After a Cancer Diagnosis

If you or a family member used Roundup for years and subsequently developed non-Hodgkin’s lymphoma or another related cancer, you have the right to seek justice. You should not have to bear the financial burden of a devastating illness caused by a company that put profits before people.

Building a successful Roundup claim requires a law firm with the resources and experience to take on a corporate giant. The legal team must prove:

  1. Exposure: That you had significant and prolonged exposure to Roundup.
  2. Diagnosis: That you have been diagnosed with a qualifying illness like non-Hodgkin’s lymphoma.
  3. Causation: That your exposure to Roundup was a substantial factor in causing your cancer.
